DHARMA TRAVELER BASIC TERMS OF SERVICE

These Terms apply to all users of the DHARMA TRAVELER Service. This includes, but is not limited to, non-registered users, registered users, and users who contribute or access Content through the DHARMA TRAVELER Service.

You may use the DHARMA TRAVELER Service only if you can form a binding contract with DHARMA TRAVELER and are not a person barred from receiving the DHARMA TRAVELER Service under the laws of the United States or any other applicable jurisdiction. You may use the DHARMA TRAVELER Service and Content only in compliance with these Terms and all applicable local, state, national, and international laws, rules, and regulations. You certify that you are legally permitted to use the DHARMA TRAVELER Service and access DHARMA TRAVELER.com. This Agreement is void where prohibited by law, and the right to access the DHARMA TRAVELERS Service is revoked in those jurisdictions. DHARMA TRAVELER makes no claim that the DHARMA TRAVELER Service and DHARMA TRAVELER.com may be lawfully viewed or that Content may be downloaded outside of the United States. Access to the Content may not be legal by certain persons or in certain countries. If you access the DHARMA TRAVELER Service from outside the United States, you do so at your own risk and you are responsible for compliance with the laws of your jurisdiction.

You may not use the DHARMA TRAVELER Service if you are under 13 years old. Any registration by anyone under 13 is void. By completing the registration process described in Section 2, you represent and warrant that you are 13 or older.

DHARMA TRAVELER CONTENT TERMS

Any text, html, URLs, images, graphics, video, other rich media content, or other materials submitted to, posted to, uploaded to, downloaded from, or appearing or existing on the DHARMA TRAVELER Service is referred to herein as Content. As a user, you can contribute Content through the DHARMA TRAVELER Service for the duration of these Terms, and you will always retain ownership of the rights you have to your Content.

You grant us a worldwide, transferable, perpetual, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, cache, store, process, adapt, modify, create derivative works of, publish, transmit, display, and distribute (in any and all media or distribution methods, now known or later developed) any Content you upload, submit, or otherwise contribute to the DHARMA TRAVELER Service. You understand that your Content may be used by our partners or us and that you may be subject to liability if you do not have adequate rights to authorize the foregoing license to your Content. You agree that the foregoing license includes the right for DHARMA TRAVELER to make such Content available to other companies, organizations or individuals for the syndication, broadcast, distribution or publication of such Content on other media and services. Without limiting the scope of the Content license we may modify or adapt your Content in order to transmit, display, or distribute it over computer networks and in various media and/or make changes to your Content as are necessary to conform and adapt that Content to any requirements or limitations of any networks, devices, services, or media.

The Content you contribute to the DHARMA TRAVELER Service can be viewed by other users of the DHARMA TRAVELER Service and possibly through third-party websites and services, so you should only provide Content that you are comfortable sharing with others under these Terms. You are responsible for any Content you contribute, whether publicly posted or privately transmitted.

We may or may not monitor or control the Content contributed via the DHARMA TRAVELER Service and we disclaim responsibility for such Content. We reserve the right at all times (but will not have an obligation) to remove or refuse to accept or distribute any Content on the DHARMA TRAVELER Service.

DHARMA TRAVELERS RESTRICTIONS & OWNERSHIP

You are invited you to use the DHARMA TRAVELER Service provided that your use is subject to and must comply with these Terms. You are not authorized to reproduce, modify, create derivative works, distribute, sell, market, publicly display, publicly perform, transmit, or otherwise use the DHARMA TRAVELER Service or any Content that is not your own except as necessary to enable you to enjoy the DHARMA TRAVELER Service as provided by DHARMA TRAVELER Without limiting the generality of the foregoing, you agree not to (and to not allow any third party to): (a) use the trademarks, trade names, service marks, logos, domain names and other distinctive brand features or any copyright or other proprietary rights associated with the DHARMA TRAVELER Service for any purpose without the express written consent of DHARMA TRAVELER; (b) register, attempt to register, or assist anyone else to register any trademark, trade name, serve marks, logos, domain names and other distinctive brand features, copyright or other proprietary rights associated with DHARMA TRAVELER; or (c) remove, obscure, or alter any notice of copyright, trademark, or other proprietary right appearing in or on any item included with the DHARMA TRAVELER Service.

The DHARMA TRAVELER Service and Content are protected by copyright, trademark, patent, trade secret, and other laws, and DHARMA TRAVELER or its licensors own all rights, title, and interest in and to the DHARMA TRAVELER Service and Content (except your Content) and all intellectual property rights therein.

DHARMA TRAVELERS COPYRIGHTS AND INTELLECTUAL PROPERTY POLICY

We respect copyright law and expect our users to do the same. The copyrights and other intellectual property rights of creators and owners of any Content are important to DHARMA TRAVELER. If you become aware of misuse of the DHARMA TRAVELER Service by any person, please contact us to report any abuse. If you receive a notice of infringement under the Digital Millennium Copyright Act for any content that is transmitted to us as part of the DHARMA TRAVELER Service, you will immediately provide notice to us so that we can take appropriate action.

DHARMA TRAVELER has adopted the following policy toward copyright infringement with respect to the DHARMA TRAVELER Service in accordance with the Digital Millennium Copyright Act, a copy of which is located at http://www.loc.gov/copyright/legislation/dmca.pdf. DHARMA TRAVELERS PROHIBITIONS

We do our best to keep the DHARMA TRAVELER Services safe, but we can not guarantee it. We need your help to do that. You agree not to do any of the following while using the DHARMA TRAVELER Service:

Use the DHARMA TRAVELER Service beyond the scope of these Terms

Post, publish, submit, link to, or transmit any text, graphics, or other material, whether as Content, Feedback, or otherwise, that: (i) is false or misleading; (ii) is defamatory; (iii) invades another’s privacy; (iv) is obscene, pornographic, or offensive; (v) promotes bigotry, racism, hatred, or harm against any individual or group; (vi) infringes another’s rights, including any intellectual property rights and rights of privacy and publicity; or (vii) violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability;

Access, tamper with, or use non-public areas of the DHARMA TRAVELER Service, DHARMA TRAVELER’s computer systems, or the technical delivery systems of DHARMA TRAVELER’s providers;
Attempt to probe, scan, or test the vulnerability of any DHARMA TRAVELER system, network, or software or breach any DHARMA TRAVELER security or authentication measures;

Access or search or attempt to access or search the DHARMA TRAVELER Service by any means (automated or otherwise) including but not limited to any engine, software, tool, agent, device or mechanism, except through the currently available published interfaces that are provided by DHARMA TRAVELER(and only pursuant to those terms and conditions), unless you have been specifically allowed to do so in a separate agreement with DHARMA TRAVELER;

Send unsolicited email, junk mail, spam, chain letters, or promotions or advertisements for products or services via the DHARMA TRAVELER Service;

Engage in any unlawful multi-level marketing, such as a pyramid scheme, on the DHARMA TRAVELER Service;

Attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the DHARMA TRAVELER Service;

Interfere with, or attempt to interfere with, the access of any member or other user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the DHARMA TRAVELER Service;

Impersonate or misrepresent your affiliation with any person or entity;

Launch any automated system, including without limitation, “robots,” “spiders,” or “offline readers,” that accesses the DHARMA TRAVELER Service in a manner that sends more request messages to the DHARMA TRAVELER servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser, including but not limited to using scripts to connect with other members or send comments or messages to other members;

Use sexually suggestive imagery or any other unfair, misleading, or deceptive Content intended to draw traffic to your profile;

Solicit login information or access an account belonging to someone else;

Collect or harvest any personally identifiable information, including account names, from the DHARMA TRAVELER Service; or

Use the DHARMA TRAVELER Service, or the communication systems provided by the DHARMA TRAVELER Service, to display any commercial advertisement that is not authorized in writing by DHARMA TRAVELER, promote or engage in commercial transactions through the DHARMA TRAVELER Service, or accept payment or anything of value from a third person in exchange for your performing any commercial activity through the unauthorized or impermissible use of the DHARMA TRAVELER Service.

DHARMA TRAVELER – THIRD PARTY WEBSITES, THIRD PARTY CONTENT, & ADVERTISING

The DHARMA TRAVELER Service may contain links or references to third-party websites or resources (including but not limited to links provided by other users of the Dharma Traveler Service), as well as Content and other information belonging to or originating from third parties (including but not limited to other users of the Dharma Traveler Service) (collectively, the Third-Party Sites, Resources, and Content). You understand that by using the DHARMA TRAVELER Service, you may be exposed to Third-Party Sites, Resources, and Content that might be offensive, harmful, inaccurate, or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive. You acknowledge and agree that Dharma Traveler is not responsible or liable, and DHARMA TRAVELER disclaims any liability, for: (i) the availability or accuracy of the Third-Party Sites, Resources, and Content; or (ii) the content, products, or services on or available from the Third-Party Sites, Resources, and Content. We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Third-Party Sites, Resources, and Content or endorse any opinions expressed via the DHARMA TRAVELER Service. You acknowledge sole responsibility for and assume all risk arising from your visits to or use of any Third-Party Sites, Resources, and Content.

The DHARMA TRAVELER Service may include advertisements, which may be targeted to the Content provided by you or others through the DHARMA TRAVELER Service, for example in your posts or queries. The types and extent of advertising provided through the DHARMA TRAVELER Service are subject to change. In consideration for DHARMA TRAVELER granting you use of the DHARMA TRAVELER Service, you agree that DHARMA TRAVELER and its third-party providers and partners may place such advertising on the DHARMA TRAVELER Service or in connection with the display of Content or information from the DHARMA TRAVELER Service whether submitted by you or others.

DHARMA TRAVELERs PRIVACY POLICY

Any information that you provide in your use of the DHARMA TRAVELER Service is subject to our Privacy Policy, which governs our collection and use of information from and about you. You consent to the collection and use (as set forth in our Privacy Policy) of your personal information, Content, and Measured Data, including the transfer of this information to the United States and/or other countries for storage, processing, and use by DHARMA TRAVELER. As part of providing you the DHARMA TRAVELER Service, we may need to provide you with certain communications, such as service announcements and administrative messages. These communications are considered part of the DHARMA TRAVELER Service, which you may not be able to opt-out from receiving.

THIRD PARTY WEBSITES, THIRD PARTY CONTENT, & ADVERTISING

You acknowledge and agree that Dharma Traveler is not responsible or liable, and DHARMA TRAVELER disclaims any liability, for: (i) the availability or accuracy of the Third-Party Sites, Resources, and Content; or (ii) the content, products, or services on or available from the Third-Party Sites, Resources, and Content. We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Third-Party Sites, Resources, and Content or endorse any opinions expressed via the DHARMA TRAVELER Service.
